You say that 2.1 refreshes the comm setting, but if that's the case how does it not work in this case?
All my hardware is listed in my profile, if you think there may be a problem in the configuration I have please let me know.

I have exactly the same problem...I've tried all I know and it keeps being random. That's what so confusing

Its really odd that people are having issues with the BU353. I also use this GPS unit. Mind you I did have issues with the GPS, when coming out of hibernation the unit would not appear. I had to unplug the unit then plug back in. Once I installed X-Port though, this fixed the issue. My only problem now is on cold days the GPS unit takes awhile to warm up and connect to SATs.

I think the best solution is a gps with a direct serial connection, what i currently have.

PLEASE READ! POSSIBLE SOLUTION FOR GPS NAVIGATION PROBLEMS!
My problem started after updating from CF 1.2 to 2.0 where CF fails to initialize the GPS device (BU353) Then I tried X-port with no success (It helped but still didn't open the port randomly)
Recently upgraded to CF 2.1, but same problem persist (Won't initializa GPS randomly)
THIS IS WHAT WORKED FOR ME!:
Downloaded and installed the 7 day trial of "FRANSON GPS GATE" and it solved my issues immediately. This is a $12.00 application smilar to X-port, but specialized in GPS devices9 Such as Garmin, USB GPS, Bluetooth GPS, NMEA, etc)
The trial can be downloaded from GPS splitter, simulator and logger. Serial port splitter. - Franson GpsGate
GOOD LUCK!
